13 This Agreement shall be governed and interpreted under the laws of Spanish territory. For any action or legal proceeding between you and HOLAPHONE for any reason relating to this Agreement, you agree to submit to the jurisdiction of the Courts of Barcelona. Any cause of action or complaint you may have regarding the site, the Software or department must begin within one (1) year after the complaint or cause of action arises or is received by lawyers. If HOLAPHONE does not insist on or enforce strict compliance with any of the provisions of this Agreement, shall not be construed as an abandonment of any provision or right. Neither the course of conduct between the parties nor trade practice shall act in favour of changing any of the provisions of this Agreement.
